Pontoon Rules & Liability Waiver
The pontoon boat may be offered as an optional add-on amenity. Use is voluntary and at the Guest’s own risk.
These rules apply to all operators, passengers, and anyone in the Guest’s party.
Assumption of Risk: Boating involves inherent risks (weather, water conditions, other vessels, equipment failure, slips/falls, drowning).
By choosing to use the pontoon, Guest voluntarily assumes all such risks.
Operator Requirements
- Only responsible, sober, competent adults may operate the pontoon.
- Operator must comply with all Illinois boating laws and lake rules.
- No operation under the influence of alcohol or drugs.
Safety Rules
- All children must be supervised at all times near water and on the boat.
- Life jackets are strongly recommended for all passengers and may be required for children by law.
- Do not exceed safe passenger limits.
- Do not allow riding on the bow, sides, or anywhere unsafe while in motion.
Weather & Conditions
- Guest is responsible for checking weather and returning before unsafe conditions.
- Do not operate during storms, lightning, heavy wind, fog, or unsafe visibility.
Damage, Loss, and Responsibility
- Guest is responsible for damages to the pontoon and for any loss/damage to equipment while in Guest’s care.
- Guest is responsible for fines, citations, towing, recovery, or other costs arising from use or misuse.
Release / Waiver / Indemnification
- Guest agrees to release and hold harmless Mars Vacation Properties from claims arising from use of the pontoon to the fullest extent permitted by law.
- Guest agrees to indemnify and defend Mars Vacation Properties against claims, damages, or expenses arising from Guest/party use of the pontoon.
